Terms and Conditions

Please read these terms and conditions carefully. By entering a competition and submitting your film for consideration, you are granting certain rights in your film to ST. MARK'S SCHOOL as specifically set forth in these terms and conditions.


Instructions on how to enter the #Create Short Film Competition (“the Competition”) and details regarding the Competition contained herein form part of these Terms and Conditions. Entry into and participation in this Competition is deemed acceptance of these Terms and Conditions.


The Competition is free to enter and open to any student/child between the age group of 15 years to 18 years from India. The Competition will be void in any other jurisdiction where it is prohibited.


Minors are entitled to enter the Competition, subject to the consent of a parent or guardian to enter and participate in the Competition, and provide that parent or guardian’s details upon entry to the Competition for verification by ST. MARK'S SCHOOL.


The Competition commences at 0000 hours IST on 31st October 2020 (“the Commencement Date”) and closes at 2300 hours IST on 31st November 2020 (the “Closing Date”). The period between the Commencement Date and the Closing Date shall be the Competition entry period (the “Competition Entry Period”).


To participate in the Competition, an Entrant must write, create, record and edit in a digital video format the following original films:


A Short Film, of a minimum of 60 seconds and a maximum of 3 minutes in duration or 180 seconds, in one of the categories listed in paragraph 19, with original content of the Entrant’s choosing (the “Short Film”); and


A Video, of a minimum of 60 seconds and a maximum of 3 minutes in duration, of the theme: FUTURE, HEROES, LOVE, HOPE and FEAR. ST. MARKS SCHOOL in its sole discretion shall decide on what constitutes a “Lockdown” film and any such decision of ST. MARK'S SCHOOL shall be final.


The Short Film must not have been entered previously in any past competitions, and the Entrant must own the whole of the copyright in the Short Film. In circumstances where the Short Film or parts thereof are derived from or contain images, sounds or material from an existing work, the Entrant must have obtained written copyright clearance from the owner of that existing work for the use of that existing work, which must be produced to ST. MARK'S SCHOOL on demand. In circumstances where the Short Film or parts thereof contain images of persons, locations, marks, trademarks and any other images which would require permission for their use, the Entrants must have received appropriate written releases for their use which must be produced to ST. MARK'S SCHOOL on demand. The Entrant through their Parent(s)/Guardian(s) shall indemnify ST. MARK'S SCHOOL in respect of any and all liability arising from any infringement of any rights whatsoever that may arise in respect of the Short Film and ST. MARK'S SCHOOL reserves the right to disqualify any Entrant who does not comply with the conditions set out in this clause.


The Short Film must not defame any person or entity, or be disparaging to any religion, race, or nation, or contain language that is lewd, obscene or inappropriate, or use any copyrights, images, marks, trademarks or logos for which the Entrant has not obtained permission for their use. ST. MARK'S SCHOOL reserves the right to disqualify any Entrant who does not comply with the conditions set out in this clause.


The Entrant shall be the one individual person most responsible for the creation, filming, producing and editing of the Short Film.


To enter the Competition, after the Commencement Date and prior to the Closing Date, the Entrant must first register their interest in the Competition by accessing the website http://create.saintmarksschool.in/ and logging in or signing up for an account. The Entrant shall then proceed to create the Short Film.


Thereafter and prior to the Closing Date, the Entrant must access the Competition Entry Page at the website http://create.saintmarksschool.in/ and complete the Competition Entry Form by entering the details required therein in full, including but not limited to the full name of the Entrant, the gender of the Entrant, the address of the Entrant and other contact details required and any other information requested therein;


The Entrant shall then receive an email confirming receipt of their entry by ST. MARK'S SCHOOL, and stating that the acceptance of their entry by ST. MARK'S SCHOOL is subject to moderation of their entry by ST. MARKS SCHOOL in its sole discretion;


ST. MARK'S SCHOOL shall aim to moderate each entry within 60 days of receipt, but moderation may take longer due to the volume of entries from time to time;


If the entry is accepted by ST. MARK'S SCHOOL following moderation, the Entrant shall receive a confirmation email of the acceptance of their entry, and ST. MARK'S SCHOOL shall provide the Entrant with a link to share their entry on the http://create.saintmarksschool.in/ website for voting purposes; and


By entering the Competition, Entrants acknowledge, agree and declare that they are aware that their participation is entirely at their own risk and that they hereby waive, surrender and relinquish in favour of ST. MARK'S SCHOOL all claims of any nature and howsoever arising (including as a result of negligence) which but for this waiver, surrender and relinquishment they may or otherwise have against ST. MARK'S SCHOOL either directly or indirectly arising out of their participation in the Competition.


By entering the Competition, Entrants hereby warrant that all information submitted is true, current and complete. Any Entrant(s) who have supplied incomplete, inaccurate or fraudulent information may be automatically disqualified. ST. MARK'S SCHOOL reserves the right to disqualify any Entrant if ST. MARK'S SCHOOL has reasonable grounds to believe that an Entrant has breached any of these terms and conditions or has tampered with the Competition process. Failure by ST. MARK'S SCHOOL to enforce any of its rights at any stage of the Competition does not constitute a waiver of those rights.


Incomplete, indecipherable or illegible entries will be deemed invalid. Entrants bear all responsibility to ensure that their entry is complete and legible, and that their Short Film is submitted in the correct format and clearly visible and audible.


Entrants are entitled to submit an unlimited number or entries, provided that each entry must comply with the entry provisions.


The costs of entering the Competition shall be borne solely by the Entrant.


The Entrant grants to ST. MARK'S SCHOOL and the sponsor, if any, a nonexclusive, irrevocable license to ST. MARK'S SCHOOL to publish their Short Film in full and communicate their Short Film to the public worldwide, and in full or in part in any other material of ST. MARK'S SCHOOL.


ST. MARK'S SCHOOL shall appoint a judging panel in its sole discretion;


After the Closing Date, ST. MARK'S SCHOOL shall determine a shortlist of the best Short Films;


The judging panel shall view the Short Films on the shortlist determined by ST. MARK'S SCHOOL;


By 31 March 2021, the judging panel shall determine the winner in the judging panel’s sole discretion;


The judging shall be based only on the subjective personal opinions of the judging panel and shall be final;


ST. MARK'S SCHOOL accepts no liability for the decisions made by the judging panel, and no correspondence will be entered into in this regard;


ST. MARK'S SCHOOL shall aim to notify the winner of this category within 90 days of the determination of the winner by email to the winner; and


ST. MARK'S SCHOOL will not enter into any correspondence in regards to the judging process;


ST. MARK'S SCHOOL reserves the right to award further Prizes to winners, or to alter the content of any Prize in whole or in part at any time, whether by adding or removing Prizes. ST. MARK'S SCHOOL shall notify any changes in the Prizes or the content of the Prize Packs from time to time as the case may be.


The Prize Pack of the Competition is non-transferable, non-negotiable, and non-refundable, is not redeemable, and is subject to availability.


All Prizes in each Prize Pack will be new and in their original packing with their applicable warranty from the manufacturer.


ST. MARK'S SCHOOL shall make reasonable efforts to deliver the Prize to the respective winners within 20 weeks of final results. ST. MARK'S SCHOOL shall not be liable for any delays in delivery of the Prize.


Each winner agrees to participate in reasonable post-competition publicity for ST. MARK'S SCHOOL, including but not limited to their attendance for interviews, photographs, videos and any other promotional activity specified by ST. MARK'S SCHOOL, and grant a nonexclusive, irrevocable license to ST. MARK'S SCHOOL to use their name, biographical details, photographs, videos, likenesses and any other information regarding the winner deemed appropriate for use by ST. MARK'S SCHOOL for any promotional and marketing purposes by ST. MARK'S SCHOOL.


Each Entrant warrants that he or she has no other agreements or arrangements with any third parties relating to the performance, service, image, name or likeness and/or other rights that may interfere with his or her entry into the Competition and the execution of his or her obligations as the winner in this Competition.


The terms and conditions of a related third-party supplier or suppliers of prizes may apply and shall be accepted by the winner or winners.


If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of ST. MARK'S SCHOOL, ST. MARK'S SCHOOL reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.


Any cost associated with accessing the Competition website is the Entrant's responsibility and is dependent on the Internet service provider used. ST. MARK'S SCHOOL makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Competition.


Except for any liability that cannot be excluded by law, ST. MARK'S SCHOOL (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under ST. MARK'S SCHOOL's control); (b) any theft, unauthorized access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by ST. MARK'S SCHOOL) due to any reason beyond the reasonable control of ST. MARK'S SCHOOL; (d) any variation in the type and specifications of the prizes to that stated in these Terms and Conditions; (e) any prize that has not been received by the claimant after dispatch by ST. MARK'S SCHOOL; (f) any prize that has been damaged in transit; (g) any tax liability incurred by an Entrant; or (h) use of the prizes.


ST. MARK'S SCHOOL collects personal information of the Entrants in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required by law, in India or other regulatory authorities. Entry to the Competition is conditional on providing this personal information, and the Entrant must consent to the use of their personal information for the purposes of the Competition


These Terms and Conditions shall be governed by and construed in accordance with the laws of the India. Entrants agree to submit to the non-exclusive jurisdiction of the courts of New Delhi.


ST. MARK'S SCHOOL hereby reserves the right to change, suspend or cancel the Competition, or to change these terms and conditions, by notice on the ST. MARK'S SCHOOL website. ST. MARK'S SCHOOL shall not be required to specify any reasons for the changes and shall not incur any liability as a result.


You must accept these Terms and Conditions. You may need to enter a valid electronic signature.


Grant of Rights


By uploading a Short Film for the Competition and in consideration of ST. MARK'S SCHOOL publishing the Short Film on the Site for you hereby grant to ST. MARK'S SCHOOL the following rights (the "Rights"), subject to a reversion to you upon notification from ST. MARK'S SCHOOL that ST. MARK'S SCHOOL no longer requires exploitation of the Rights:


All rights in the Short Film and all underlying material thereto (i.e. the Pitch, Script or any other material upon which the Short Film is based), including, without limitation, the exclusive, worldwide right to exploit, sublicense, and assign the Short and all ancillary and derivative rights thereto in all media now known or hereafter devised in any and all languages including the right to permit such Short Film to be posted and viewed by third parties on the Site or elsewhere.


The right in perpetuity to use your name, address, voice, statements, biography, photograph, image and other likenesses without any further consideration, in any medium, including, without limitation, in still photos, film, video, television, radio and the internet, and in any publicity carried out by ST. MARK'S SCHOOL or any of its related entities, insurers, promotions companies and service providers, unless prohibited by law.


The right to change, add to, take from, translate, reformat or reprocess the Short Film in any manner ST. MARK'S SCHOOL may in its sole discretion determine.


Disclaimer


It is possible that Films posted to the Site may be downloaded or copied by third parties without our permission, and you waive any claim against ST. MARK'S SCHOOL for such actions.


ST. MARK'S SCHOOL is not responsible for telecommunications, network, electronic, technical or computer failures of any kind or for lost, stolen, misdirected, mutilated, damaged, garbled, delayed, misdirected, incorrectly addressed, undeliverable, destroyed, late, incomplete or illegible submissions, including: any hardware or software failures of any kind; lost or unavailable network connections; failed, incomplete or garbled computer, telephone or satellite transmissions; incorrect, inaccurate transcription or loss of submission information; typographical or system errors; any viruses transmitted to computers of Members via the internet; problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers or computer equipment; or technical problems or traffic congestion on the internet or any combination thereof; or for any technical or human errors associated with the Competition.


ST. MARK'S SCHOOL shall not be responsible for any injury or damage to a Entrant’s or any other person’s computer related to or resulting from participating in the Competition, or downloading any material for the Competition which may limit a Member’s ability to participate.


ST. MARK'S SCHOOL may disqualify anyone from participating in the Competition or winning a prize, if in its sole discretion, it determines that such person is attempting to undermine the legitimate operation of the Competition by cheating, hacking, deception or other unfair practices or intending to annoy, abuse, threaten or harass any other Entrants or ST. MARK'S SCHOOL’s representatives.
